Subject

These rules ("Rules") govern the contest for the production of artistic works ("Contest") that the company Girolibero S.r.l., based in Via Conforto da Costozza no. 7, 36100 Vicenza (VI) - Italy, VAT NO. 03794470249 ("Girolibero") has established in order to foster the knowledge and enhancement of travel culture as well as to promote organized travel opportunities. To this end, any individual ("Participant(s)") is given the chance to participate in one of the contests described below by submitting photographs or videos ("Works") under the terms made explicit in these Rules.

Contributions and award

The Contest admits two types of entries:"photo" type and "video" type. There is only one prize (further details in “How the Contest works"). Participating Works must describe and represent Girolibero concept of traveling.

Participants will be subscribed to the Girolibero newsletter, which can be unsubscribed from at any time (for privacy see below under “notice pursuant to art.13 of EU regulation no. 2016/679 (gdpr)")

How the contest works

Participants can register for the contest for free, even without having participated in a Girolibero tour. They have to submit their Works by January 31, sharing them on the website contest.girolibero.com

• "Photo": the work must consist of one or more photographs, for a maximum number of 10 (ten) photographs. Each photograph must be between a minimum of 1 Mb (1,000 Kb)and a maximum of 5 Mb (5,000 Kb) in size, and must be uploaded using JPG, PNG or HEIC formats.
• "Video": the work must consist of a video of a maximum duration of 15 (fifteen) seconds, maximum size 50 Mb, made in vertical format 1080×1920 (by way of example reel format, stories, tiktok). The upload must be made using MP4, AVI or MOV format.

The jury will be composed of experts belonging to the world of travel industry and visual arts, freely and independently chosen by Girolibero, also within its own organization ("Commission"). The evaluation criteria for awarding the prize shall be independently decided by the Commission, whose judgment of the compliance of the Works with the object of the Contest in each Category shall be discretionary and unquestionable. The winning Participant will receive a voucher worth 500 (five hundred) Euros, which he/she may use to book one of the trips in the "original" category, visible at this link https://www.girolibero.com/all-tours/original_tour, provided that (i) the minimum duration of the chosen trip is 7 (seven) nights; and (ii) the departure date is by December 31 of the year of the award of the prize (e.g. December 31, 2024 for the winner awarded by March 31, 2024). It is understood that any cost not explicitly included in the trip description in the link above has to be paid by the Participant. The portion of the tour cost which is not covered by the voucher must be paid by the Participant in accordance with Girolibero standard terms and conditions. The name of the winner will be announced on Girolibero website girolibero.com ("Website"), in the newsletter and on Girolibero social channels. The winner will be named by March 31 each year.

License of use

By participating in the Contest, each Participant grants Girolibero a worldwide, non-exclusive and free license to use the Works so that Girolibero may publish them on its website and/or other social channels or portals related to the same, display or project them or otherwise reproduce them in any exhibitions or other initiatives that Girolibero decides to organize, as well as use them in its advertising materials, including printed materials. Each Participant may revoke the license at any time by means of a notice to be sent to Girolibero in writing to the e-mail address info@girolibero.it. Following receipt of such revocation, Girolibero commits within a reasonable time to removing the Works from its Site and/or other social channels or portals referred to it, to withdrawing them from any physical spaces open to the public in which they were published, exhibited or reproduced. It is understood that with respect to any printed materials in which such Works had been reproduced and distributed, Girolibero will not be obligated to retrieve any materials that had already been distributed and that Girolibero will benefit from a reasonable period of time to complete the distribution of printed materials already in its possession. In the case of catalogs, such reasonable time includes at a minimum the season and/or initiative to which the catalog refers.

Warranty and liability

Each Participant commits to submitting Works whose contents are not false, defamatory, untrue, offensive, contrary to any rule of law or morality and public order and in any case not in compliance with the current regulations. Each Participant agrees not to upload to the Portal any material protected by third party copyright and/or damaging to any intellectual property rights of third parties. Each Participant warrants that he/she has full and exclusive title and ownership of the Work, as well as possession of any necessary authorizations of those who, in any capacity, are quoted, portrayed or filmed in it. The Participant assumes direct responsibility for the submitted Work by indemnifying and holding Girolibero harmless from any request, action, claim for compensation made for any reason by third parties in relation to the ownership of copyrights and any other rights related to the Work. Girolibero may exclude any Work from the Contest if-at its sole discretion-it deems that the criteria described in these Rules are not met, in particular and without limitation should the Work contain: objects and content infringing on the rights of others; intellectual property rights of third parties; copyrights, trademarks, or any other rights subject to protection or owned by third parties; promotion of discrimination based on race, sex, religion, nationality, disability, sexual orientation, age, or any other condition protected by law. Girolibero gives no warranty as to the availability or proper functioning of the Website and/or the Portal.

Availability and changes to the Rules

These Rules are available on the website. Any changes or additions that may be made to these Rules by Girolibero will be brought to the attention of Participants by appropriate information via the website and/or any other means as Girolibero deems appropriate.

Notice pursuant to art.13 of EU regulation no. 2016/679 (gdpr)

Girolibero informs that all personal data collected will be processed in accordance with EU Regulation no. 2016/679 (GDPR - General Data Protection Regulation) and Italian Legislative Decree no. 2003/196 (Privacy Code).

The data controller is Girolibero S.r.l. The provision of data by Participants is optional, but a refusal to provide them determines the impossibility of participating in the Contest. Each individual has the right to exercise the rights foreseen by Articles 15 to 22 of the GDPR by writing to Girolibero S.r.l. at the e-mail address privacy@girolibero.it. The extended privacy policy is available on the website.

Applicable law, related compliance and jurisdiction The Rules and the initiative described herein are subject to Italian law. The initiative described by the Rules is not subject to the legislation on prize events, in light of the exclusion provided for by art.6 paragraph 1 letter a) of Presidential Decree October 26, 2001, no. 430, as the award subject of the prize to the authors of the Works submitted within the Contest and selected as winners has the character of consideration for provision of services or will represent recognition by the Commission and Girolibero to the personal merit of the author of the Works. Any dispute arising out of these Rules in connection with the Contest described and governed herein shall be referred to the exclusive jurisdiction of the Court of Vicenza.
